১। পরিচিতি

ক. আপনার অ্যাকাউন্ট

প্ল্যাটফর্মে প্রদত্ত নির্দিষ্ট পরিষেবাগুলোতে অ্যাক্সেস পেতে, আমরা আপনার কাছ থেকে একটি অ্যাকাউন্ট তৈরি করতে বা ব্যক্তিগত তথ্য প্রদান করতে অনুরোধ করতে পারি। আমরা আমাদের একক এবং সম্পূর্ণ বিবেচনায় যে কোনো সময় ব্যবহারকারীর নাম এবং/অথবা পাসওয়ার্ড অবৈধ ঘোষণা করতে পারি, কোনো কারণ বা পূর্ব নোটিশ ছাড়াই, এবং এই অবৈধ ঘোষণার কারণে হওয়া বা উদ্ভূত যে কোনো ক্ষতির জন্য আমরা দায়বদ্ধ বা দায়ী থাকব না।

খ. গোপনীয়তা

অবৈধ উদ্দেশ্যে সাইট ব্যবহার করা।

প্ল্যাটফর্ম বা পরিষেবাগুলির সাথে সংযুক্ত অন্যান্য কম্পিউটার সিস্টেম বা নেটওয়ার্কগুলিতে অননুমোদিত অ্যাক্সেস বা অন্যথায় হস্তক্ষেপ বা ব্যাহত করার প্রচেষ্টা।

সাইটের অন্যের ব্যবহার এবং উপভোগে হস্তক্ষেপ করা।

গণপ্রজাতন্ত্রী বাংলাদেশ সরকার কর্তৃক অবৈধ বলে বিবেচিত যে কোন নিষিদ্ধ উপকরণ সাইটের মাধ্যমে পোস্ট, প্রচার বা প্রেরণ করা।

যেকোন উপায়ে, যেকোন সফ্টওয়্যার বা উপাদান ব্যবহার করা বা আপলোড করা যা ধারণ করে, বা যা আপনার সন্দেহ করার কারণ আছে যেটিতে ভাইরাস, ক্ষতিকারক উপাদান, দূষিত কোড বা ক্ষতিকারক উপাদান রয়েছে যা সাইটের ডেটা বা ক্ষতি করতে পারে বা অপারেশনে হস্তক্ষেপ করতে পারে অন্য গ্রাহকের কম্পিউটার বা মোবাইল ডিভাইস বা সাইটের, এবং কোনো সংযুক্ত কম্পিউটার নেটওয়ার্কের গ্রহণযোগ্য ব্যবহারের নীতি, কোনো প্রযোজ্য ইন্টারনেট মান এবং অন্য কোনো প্রযোজ্য আইনের সাথে সামঞ্জস্য রেখে সাইটটি ব্যবহার করা।

চ. দায়বদ্ধতা বর্জন

প্ল্যাটফর্মে অর্ডার/লেনদেন করার ক্ষেত্রে আপনার দ্বারা কৃত কোনো ক্ষতি বা ক্ষতির জন্য আমরা দায়ী থাকব না।

আমরা কোনো ব্যবসা বা ব্যক্তিগত ক্ষতির জন্য দায়ী থাকব না (যার মধ্যে লাভ, রাজস্ব, চুক্তি, প্রত্যাশিত সঞ্চয়, ডেটা, সদিচ্ছা, বা অপচয়ের ক্ষতি সহ কিন্তু সীমাবদ্ধ নয়) বা অন্য কোনো পরোক্ষ বা ফলস্বরূপ ক্ষতি যা উভয়ের কাছে যুক্তিসঙ্গতভাবে পূর্বাভাসযোগ্য নয়।

ছ. তামাক কেনার ক্ষেত্রে আপনার উদ্যোগ

তামাক পণ্য ব্যবহার (নিয়ন্ত্রণ) আইন ২০০৫ এর যথাযথ সম্মতিতে, আপনি স্বীকার করেন যে আপনি একজন প্রাপ্তবয়স্ক (১৮+) এবং একজন ধূমপায়ী। উপরন্তু, আপনি এই ব্যবহারকারী চুক্তির অধীনে অঙ্গীকার করেন যে আপনার দ্বারা নিশ্চিত করা ঠিকানায় পণ্য এবং পরিষেবা সরবরাহের সময়, আপনি ওয়েবসাইটে আপনার দ্বারা দেওয়া অর্ডারটি ব্যক্তিগতভাবে গ্রহণ করার জন্য নিজে উপস্থিত থাকবেন।

আপনার নয় এমন কোনো উপাদান পাঠাতে, ব্যবহার করতে বা পুনরায় ব্যবহার করতে; বা বেআইনি, আপত্তিকর (যৌন সংক্রান্ত বা যা বর্ণবাদ, ধর্মান্ধতা, ঘৃণা বা শারীরিক ক্ষতির প্রচার করে এমন উপাদান সহ কিন্তু সীমাবদ্ধ নয়), প্রতারণামূলক, বিভ্রান্তিকর, অপমানজনক, অশালীন, হয়রানিমূলক, নিন্দামূলক, মানহানিকর, অশ্লীল, পেডোফিলিক বা হুমকি; জাতিগতভাবে আপত্তিকর, অপমানজনক বা কপিরাইট, ট্রেডমার্ক, গোপনীয়তা বা অন্য কোনো মালিকানা তথ্য বা অধিকার লঙ্ঘন; অথবা অন্যথায় তৃতীয় পক্ষের জন্য ক্ষতিকর; বা অর্থ পাচার বা জুয়ার সাথে সম্পর্কিত বা প্রচার করে; বা অপ্রাপ্তবয়স্কদের জন্য যে কোনো উপায়ে ক্ষতিকর; বা অন্য ব্যক্তির ছদ্মবেশ; বা বাংলাদেশের ঐক্য, অখণ্ডতা, নিরাপত্তা বা সার্বভৌমত্ব বা বিদেশী রাষ্ট্রের সাথে বন্ধুত্বপূর্ণ সম্পর্কের জন্য হুমকি; বা আপত্তিকর বা অন্যথায় যে কোনো উপায়ে বেআইনি; বা যা সফ্টওয়্যার ভাইরাস, রাজনৈতিক প্রচারণা, বাণিজ্যিক অনুরোধ, চেইন লেটার, গণ মেইলিং বা যেকোনো "স্প্যাম" নিয়ে গঠিত বা রয়েছে

বিক্রেতা অর্ডার প্রেরণের আগে যে কোনো অর্ডার নিজ সিদ্ধান্তে বাতিল করার অধিকার সংরক্ষণ করে। আমরা নিশ্চিত করব যে এই ধরনের বাতিলের বিষয়ে সময়মতো আপনাকে ইমেইল বা এসএমএসের মাধ্যমে জানানো হবে। এই ধরনের বাতিলকরণের ক্ষেত্রে প্রদত্ত যে কোনো অগ্রিম অর্থ নির্ধারিত সময়সীমার মধ্যে আপনাকে ফেরত দেওয়া হবে।

কোনো ভাউচার প্রত্যাখ্যান, বাতিল বা প্রত্যাহার বা কোনো কারণে কোনো গ্রাহকের ভাউচার ব্যবহারে ব্যর্থতা বা অক্ষমতার ফলে উদ্ভূত কোনো আর্থিক ক্ষতির জন্য Let’s Vibe কোনো গ্রাহক বা পরিবারের কাছে দায়বদ্ধ থাকবে না।

মেয়াদ উত্তীর্ণ হলে ভাউচার পরিবর্তনযোগ্য নয়।

নিরাপত্তা এবং জালিয়াতি

আপনি যখন একটি ভাউচার ব্যবহার করেন, তখন আপনি Let’s Vibe-এর কাছে ওয়ারেন্টি দেন যে আপনি ভাউচারটির যথাযথভাবে অনুমোদিত প্রাপক এবং আপনি এটি সরল বিশ্বাসে ব্যবহার করছেন।

আপনি যদি ভাউচার রিডিম করেন, রিডিম করার চেষ্টা করেন বা ছাড় পাওয়ার জন্য ভাউচার রিডিম করার জন্য উৎসাহিত করেন যার আপনি যোগ্য নন, তাহলে আপনি একটি দেওয়ানি বা ফৌজদারি অপরাধ করতে পারেন।

ব্যবসায়িক উদ্দেশ্যে Let’s Vibe পণ্য পুনরায় বিক্রি করা কঠোরভাবে নিষিদ্ধ। যদি কোন অননুমোদিত ব্যক্তি উপরোক্ত কাজটি করে থাকে তবে তার বিরুদ্ধে আইনগত ব্যবস্থা নেওয়া হতে পারে।

চ. ট্যাক্স

আপনি সাইট থেকে পণ্য কেনার সাথে সম্পর্কিত সমস্ত ফি/খরচ/চার্জ প্রদানের জন্য দায়ী থাকবেন এবং আপনি প্রচলিত আইন অনুযায়ী যে কোনো এবং সমস্ত প্রযোজ্য কর বহন করতে সম্মত হন।

Any prepayments made in case of such cancellation(s), shall be refunded to you within the time frames stipulated.

You confirm that the product(s) or service(s) ordered by you are purchased for your internal / personal consumption and not for commercial re-sale. You authorize us to declare and provide declaration to any governmental authority on your behalf stating the aforesaid purpose for your orders on the site. The seller or the site may cancel an order wherein the quantities exceed the typical individual consumption. This applies both to the number of products ordered within a single order and the placing of several orders for the same product where the individual orders comprise a quantity that exceeds the typical individual consumption. All prices are listed in Bangladeshi taka (BDT) and are inclusive of GST and are listed on the site by the seller that is selling the product or service. Please note that this price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart does not reserve the price shown at that time. Delivery Time

For regular delivery, products will be delivered within 48 hours inside Dhaka city. Locations outside of Dhaka will require 3 working days to be delivered.

Refund

Claims that are in line with our Refund Policy will be settled and customers would get refund of the amount that they have paid as per the policy.

Promotional Voucher

Each issued promotional voucher (app voucher and new customer voucher) will be valid for use by a customer only once. Multiple usages by changing the identity is illegal.

No promotional voucher shall apply for leaf products.

Promotional voucher is non-refundable and cannot be exchanged for cash in part or full and is valid for a single transaction only.

Promotional voucher may not be valid during sale or in conjunction with any special promotion.

Voucher will work only if minimum purchase amount and other conditions are met.

Let’s Vibe reserves the right to vary or terminate the operation of any voucher at any time without notice.

Let’s Vibe shall not be liable to any customer or household for any financial loss arising out of the refusal, cancellation or withdrawal of any voucher or any failure or inability of a customer to use a voucher for any reason.

Vouchers are not replaceable if expired.

Security and Fraud

When you use a voucher, you warrant to Let’s Vibe that you are the duly authorized recipient of the voucher and that you are using it in good faith.

If you redeem, attempt to redeem or encourage the redemption of a voucher to obtain discounts to which you are not entitled, you may be committing a civil or criminal offence.

If we reasonably believe that any voucher is being used unlawfully or illegally, we may reject or cancel any voucher/order and you agree that you will have no claim against us in respect of any rejection or cancellation. Let’s Vibe reserves the right to take any further action it deems appropriate in such instances.

E. RESELLING Let’s Vibe PRODUCTS

Reselling Let’s Vibe products for business purposes is strictly prohibited. If any unauthorised personnel is found committing the above act, legal action may be taken against him/her.

F. TAXES

You shall be responsible for payment of all fees/costs/charges associated with the purchase of products from the site and you agree to bear any and all applicable taxes as per prevailing law.

G. REPRESENTATIONS AND WARRANTIES

We do not make any representation or warranty as to specifics (such as quality, value, saleability, etc.) of the products or services listed to be sold on the site when products or services are sold by third parties.
